1. About Swappy

Swappy ("we", "us", "our", the "Service") is a community platform operated in the United Kingdom that helps learner drivers find another learner to swap their DVSA practical driving test with. By using Swappy you ("you", "the user") agree to these Terms & Conditions. If you do not agree, please do not use the Service.

2. Eligibility

• You must be at least 17 years old (the minimum age to take a UK driving test).
• You must hold a valid DVSA practical driving test booking, or be an Approved Driving Instructor (ADI) or driving school managing tests on behalf of pupils.
• You must provide accurate information about your test and your contact details.

3. What Swappy Does (and Does Not) Do

Swappy is a matchmaking and communication platform. We do not book, change, cancel or hold driving tests on your behalf. All actual test changes are completed by you (and your swap partner) directly with the DVSA, either by calling DVSA together or via our optional 3-way call assistance feature.

Swappy is not affiliated with, endorsed by, or operated by the DVSA. The DVSA is the only authority that can confirm a test change.

4. Your Account

• You are responsible for keeping your login credentials secure.
• You must not share your account, impersonate another person, or create multiple accounts to game the system.
• We may suspend or terminate accounts that breach these terms, post false listings, or abuse other users.

5. Listings & Swap Conduct

• You must only list a test you have genuinely booked with the DVSA.
• You must keep your listing accurate and remove or update it promptly if your test changes.
• You agree to communicate honestly and respectfully with potential swap partners.
• You will not use Swappy to harass, defraud, spam, or otherwise harm other users.
• Selling, reselling, or trading test slots for money outside the Premium subscription fee paid to Swappy is strictly prohibited and may breach DVSA terms.

6. DVSA Booking References

To complete a swap with the DVSA, both learners must share their booking reference numbers with each other (or with the DVSA on a 3-way call). Booking references are only shared between confirmed swap partners. By proceeding with a swap you authorise the necessary sharing of your booking reference for the sole purpose of completing the test change.

7. Paid Invite Codes & One-Off Premium+ Access

• Non-Refundable: Invite codes purchased by ADIs or schools are non-refundable under all circumstances, including if the code is not redeemed, lost, or shared without authorisation.
• What You're Paying For: Purchase of a code grants the redeemer 6 months of Premium+ access from the moment they enter the code. You are not paying for swap guarantees, service levels, availability of swap partners, or a minimum number of swap offers.
• No Service Level Guarantees: Premium+ access includes optional features such as email/SMS match alerts and priority notifications. Swappy makes no guarantee of response time, alert delivery, or that any specific swap will be found or offered. Swap availability depends entirely on other learners using the platform.
• Limited Liability for Codes: If a code is lost, forgotten, or used by an unauthorised person due to negligence on your part, Swappy is not liable for the cost. We recommend secure distribution (encrypted email, SMS, or printed with physical handoff) and do not recommend posting codes publicly.
• Code Expiry: Codes do not expire unless otherwise stated at purchase. However, once redeemed, the 6-month premium access period begins immediately and does not extend.
• Bulk Purchase Terms: Bulk purchases of codes are subject to a minimum order of 10 codes and are invoiced at the rate shown at checkout. No discounts or refunds apply for partial redemption across your learner base.

7A. Premium Subscriptions

• Premium and Premium+ subscriptions are billed via Stripe at the price displayed at checkout.
• Subscriptions auto-renew until cancelled. You can cancel at any time from your Settings page; cancellation takes effect at the end of the current billing period.
• Free trials, where offered, automatically convert to a paid subscription unless cancelled before the trial ends.
• We do not provide refunds for partial billing periods, except where required by UK consumer law.
• Prices may change with at least 14 days' notice for renewing subscribers.
• What Your Subscription Covers: A Premium or Premium+ subscription buys access to the platform and its features — including swap listings, browsing and proposing swaps, alerts, and the members-only Community Resources directory. It does not buy a swap, a swap partner, an earlier test date, or any particular outcome.
• Non-Refundable: Subscription fees are non-refundable, including where you do not find a swap partner, do not use the features, or choose to stop using the Service. This does not affect your statutory rights under UK consumer law.
• No Implied Guarantees: No statement on our website, in marketing, in emails, or in support conversations should be taken as a promise or implied guarantee of a swap, a match, a response from another user, or a successful DVSA change.

7B. Community Resources Directory

• The Community Resources directory lists third-party groups and communities that we do not own, operate, moderate, or endorse (for example Facebook groups, forums, or messaging groups).
• These links are provided as a convenience only. Activity in those groups is outside Swappy and cannot be tracked, verified, moderated or supported by us. Any swap arranged there is entirely at your own risk.
• Access to the directory is part of your paid access to the platform. Links may be added, changed, or removed at any time, and a group becoming unavailable, inactive, private, or deleted does not entitle you to a refund.
• Never share personal, financial, or identity documents in third-party groups, and never pay anyone for a test slot. Swappy accepts no liability for loss, scams, or disputes arising from your use of third-party groups.

8A. ADI & Driving School Plans

Approved Driving Instructors and driving schools may purchase pupil seats to provide their learners with Premium or Premium+ access. The school/ADI is responsible for the conduct of seats they assign and for cancelling unused seats. Seats are non-transferable between learners once activated, except via the Settings > Manage Seats tools we provide.

9B. 3-Way DVSA Call Feature

Premium and Premium+ users may use our automated 3-way calling feature to bridge a call between you, your swap partner, and the DVSA. This is a best-effort convenience feature. Successful completion of the swap depends on DVSA call wait times, agent availability, and both parties being ready and contactable. Swappy is not liable if the DVSA is unable or unwilling to complete the swap on a given call.

10C. No Guarantees

We do not guarantee that you will find a swap partner, that any specific test date will become available, or that the DVSA will approve any particular change. Match availability depends entirely on other learners using the platform.

11D. Acceptable Use

You must not:

• Use bots, scrapers, or automated tools to interact with Swappy or the DVSA via Swappy.
• Post false, misleading, fraudulent, or offensive content.
• Attempt to gain unauthorised access to other accounts or our systems.
• Use Swappy in any way that violates UK law or DVSA terms.

12E. Intellectual Property

The Swappy name, branding, design, written content, code, and platform are owned by us and protected by UK and international copyright and trademark law. You may not copy, reproduce, or republish material from Swappy without written permission.

13F. Limitation of Liability

To the fullest extent permitted by UK law, Swappy is provided "as is" and we are not liable for any indirect, incidental, or consequential losses arising from your use of the Service, including (without limitation): missed tests, lost test fees, lost lesson costs, travel costs, or emotional distress. Our total liability to you for any claim shall not exceed the amount you have paid us in subscription fees in the 12 months preceding the claim. Nothing in these terms limits liability for death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.

14G. Termination

You may close your account at any time from the Settings page. We may suspend or terminate your account immediately if you breach these terms, abuse the Service, or post fraudulent listings. Termination does not entitle you to a refund of subscription fees already paid.

15H. Privacy & Data

Your privacy is important to us. Please read our Privacy Policy, which forms part of these Terms.

16I. Changes to These Terms

We may update these Terms from time to time. We'll update the "last updated" date at the top of this page. Continued use of Swappy after changes means you accept the updated Terms.

17J. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
